Terms of Service

TERMS OF SERVICE FOR ELECTRONIC SERVICES

I. Definitions

Whenever the following capitalized terms are used in these Terms and its annexes, they should be understood as follows:

  1. Boyfriend.lgbt – the entity owning the Boyfriend.lgbt Service – Digital Industries sp. z o.o., with its registered office in Kraków, ul. Generała Józefa Dwernickiego 6/4, 31-530, NIP: 675-163-32-75, REGON: 369266960, e-mail: [email protected],
  2. Account – an account maintained for the User by Boyfriend.lgbt under an individual login and password, which is a collection of resources where the User's data and information about their activities on the Service are stored,
  3. Terms of Service – these Terms of Service, which are the terms of service as defined in Article 8 of the Polish Act of 18 July 2002 on the Provision of Electronic Services (Dz. U. of 2002 No. 144, item 1204, as amended), together with the Privacy Policy and the Cookies Policy, which are annexes to these Terms,
  4. Registration – the procedure of creating an Account by the User,
  5. Service – the online service available at the URL https://boyfriend.lgbt along with dedicated applications available for IOS and Android operating systems,
  6. Content – all content published by Users on the Service, in particular written, graphic, multimedia content, software, as well as ratings and comments,
  7. Agreement – an agreement between the User and Boyfriend.lgbt, entered into by accepting the Terms,
  8. Service Offerings – services provided by Boyfriend.lgbt through the Service to Users,
  9. User – a person using the Service who is at least 18 years old, logged into their Account.

II. Use of the Service

  1. Boyfriend.lgbt is a service created to provide a virtual space for the exchange of information about Users and the establishment of relationships between Users.
  2. Only registered Users have access to the Service.
  3. The use of the service is free of charge; however, Boyfriend.lgbt reserves the right to introduce paid services within the Service.
  4. Boyfriend.lgbt reserves the right to send Users information about the functioning of the Service and technical notices via email, which do not constitute commercial information under the Electronic Services Act of 18 July 2002.
  5. Users must use the Service in accordance with its intended purpose and, in particular, not introduce Content that:
    • disrupts the operation of the Service,
    • contains viruses or harmful programs,
    • infringes the rights of the Service, Users, or third parties,
    • is offensive or contrary to social norms.

III. Technical Requirements

  1. To use the Service, it is necessary to have a device with Internet access and a web browser.
  2. Some functionalities of the Service may require additional software (e.g., Flash, text editors, PDF viewers).
  3. Users bear the costs of Internet access in accordance with the pricing of their providers.

IV. Registration

  1. Registration in the Service is voluntary and free of charge, and it involves filling out the registration form available on the Service.
  2. During the Registration process, Users must provide: email address, password, login, first name, and date of birth.
  3. Registration may be completed by an individual who has full legal capacity and is at least 18 years old.
  4. Users gain access to their Account by providing their email address and password.
  5. Accounts may not be transferred to another person.

V. Conclusion of Agreement, Right to Withdraw, and Account Deletion

  1. After completing the Registration, a message containing an activation link will be sent to the email address provided. Clicking on the activation link results in the conclusion of the Agreement.
  2. Users may withdraw from the Agreement at any time for any reason. To withdraw from the Agreement, the User may delete their Account or notify Boyfriend.lgbt of their request for deletion.
  3. The Agreement is valid as long as the User maintains an active Account.
  4. Boyfriend.lgbt may terminate the Agreement if the User violates the law or the Terms of Service.

VI. Free Services of the Service

  1. Users may enter additional personal data in their User panel.
  2. The Service allows Users to post their data and photos.
  3. Registered Users can view the profiles of other Users.
  4. Boyfriend.lgbt offers the following services:
    • the ability to publish Content,
    • the ability to send messages to other Users (up to 3 new conversations per day).

VII. Premium Service

  1. Boyfriend.lgbt offers a paid Premium Service to Users.
  2. Users can purchase Premium Service for 1, 3, 6, or 12 months.
  3. Payments for the service are made in advance for the entire billing period.
  4. Premium Services include:
    • unlimited messaging,
    • access to information on who viewed the profile,
    • increased privacy by making the account visible only to paid Users.

VIII. Violation Reporting Procedure

  1. In case of any Content on the Service that violates the law, particularly intellectual property or personal rights of third parties, or is contrary to the Terms of Service, any User is required to report it to Boyfriend.lgbt.
  2. After receiving such a report, Boyfriend.lgbt will assess its credibility and take action by removing the Content, sending a warning to the User in violation, or deleting the Account.

IX. Complaints Procedure

  1. If the quality of the Services provided by Boyfriend.lgbt is unsatisfactory or if Boyfriend.lgbt fails to fulfill its obligations, Users are entitled to file a complaint.
  2. Complaints must be submitted via email to [email protected] with the subject line "complaint."
  3. Properly submitted complaints should include the following information:
    • User’s name and email address,
    • A brief description of the issue.
  4. Complaints are reviewed within 14 days.

X. Amendments to the Terms of Service

  1. Boyfriend.lgbt reserves the right to amend the Terms of Service for important reasons, such as changes required by law or to improve or expand the range of services offered.
  2. Any changes to the Terms will be communicated to Users via a system message or email.
  3. If a User does not accept the changes to the Terms, they may terminate the Agreement within 14 days of receiving the notice by sending an email to Boyfriend.lgbt.
  4. If the User does not terminate the Agreement within this period, the changes will be considered accepted, and they will become binding after the 14-day period.
  5. The Terms of Service are effective as of October 25, 2024.
